Promoter Program Policy

This Promoter Program Policy applies to medXcentral and "the Service” as described and defined in our General Terms of Service. Participation in our Promoter Programs requires agreement and compliance with our General Terms of Service as well as our Privacy Policy. Information we collect in relation to your participation in our Promoter Programs is protected in accordance with our Privacy Policy. In consideration of the fact that we will be sharing revenue to those enrolled in our Promoter Programs, we may collect sensitive, personally identifiable information for the purpose of reporting income as required by the Internal Revenue Service or other regulatory entity.
This Promoter Program Policy may be changed without notice to you. We may post notice of change, but are not required to do so. It is your responsibility to monitor this Promoter Program Policy for changes.

General Promoter Program Concepts:
Our Promoter Programs, with the exception of the “Keep Me Free” level, have been designed as a “Pay-to-Participate” revenue sharing model. Your payment supports infrastructure and future automation as well as overall profitability. In return, we share our profit (generated from Finder's Fees/Referral Fees paid to the network by those seeking Medical Professionals to fill open job requisitions) with you (pursuant to the Promoter Program level you enroll in):

Who may participate – Any individual or any entity with an audience of health care and/or medical professionals so long as no marketing or advertising of any sort, promoting medXcentral or the Service, is referenced, linked or otherwise advertised on a site with objectionable content. Objectionable content is determined in our sole discretion and includes, but is not limited to:

Violent content, racial intolerance, or advocacy against any individual, group, or organization

Pornography, adult, or mature content
-
Hacking/cracking content
-
Illicit drugs and drug paraphernalia
-
Excessive profanity
-
Gambling or casino-related content
-
Content regarding programs which compensate users for clicking on ads or offers, performing searches, surfing websites, or reading emails

Excessive, repetitive, or irrelevant keywords in the content or code of web pages
-
Deceptive or manipulative content or construction to improve your site's search engine ranking, e.g., your site's PageRank

Sales or promotion of weapons or ammunition (e.g., firearms, fighting knives, stun guns)

Sales or promotion of beer or hard alcohol
-
Sales or promotion of tobacco or tobacco-related products

Illegal Sales or promotion of prescription drugs

Sales or promotion of products that are replicas or imitations of designer goods
-
Sales or distribution of term papers or student essays

Any other content that is illegal, promotes illegal activity, or infringes on the legal rights of others

Candidate Ownership – The Candidate (the individual medical professional registering with medXcentral and the Service), "owns" The Candidate. We promote Candidate (Job Seeker) independence, freedom, security and self sufficiency. When The Candidate registers to build their profile within the Service, they are given the opportunity to indicate which Promoter introduced them to our free service. During that registration process, if The Candidate enters your Promoter ID as the source of their discovery of the Service (specifically The Candidate Network), that Candidate will be linked to your Promoter Account for as long as your Promoter Account remains in good standing and is paid current. If/When, and each time that Candidate connects to an employer through our system, when that employer pays the referral fee, we share that referral fee with the Promoter who brought the Candidate to The Candidate Network.

Candidate Registration – You may promote our free service and educate your audience about our concepts. YOU MAY NOT enter Candidates into our system directly or indirectly. Each Candidate will be required to validate their voluntary entry and participation within the Service (specifically The Candidate Network).

Your basic Requirements as a Promoter – Simply recommend our free service and job seeker privacy concepts to your audience of medical professionals and politely and respectfully request that they enter your Promoter ID when prompted by our Candidate Registration form. Educating your audience is the preferred method of promotion.

Marketing as a Promoter – We are a company of high standards and ask that Promoters market our service and concept accordingly. We promote freedom and independence as well as privacy and security for Medical Professionals. We ask Promoters to refrain from promoting our service through unethical practices (as determined in our sole discretion). Unethical Marketing practices include, but are not limited to: SPAM, auto-dialing telemarketing systems, unsolicited faxes and forum or blog posts which violate the allowable content policy and terms of other site's on the Internet where you may be blogging and or participating within that site's community. Our program can create a significant income stream. We appreciate ambition but ask/insist that promoters operate ethically.

Other restricted Marketing Methods - Promoters shall not use Television or Radio advertising of any kind to "Promote" our services pursuant to our Promoter Programs and this "Promoter Policy".
Removal from The Candidate Network Promoter Program:
When you participate as a Promoter of our services, you are agree to uphold our Terms of Service, Privacy Policy, Promoter Policy and all other applicable terms and policies within the the Service. If, in the sole discretion of The Company, you are found in breach of the aforementioned policies and ethical practice standards, including non-payment of Promoter Program fees upon payment due date, your Promoter Program may be immediately terminated. You will continue to receive payments due per your Promoter Program registration for Candidates which have accepted assignments prior to the effective date of your Promoter Program termination. However, if it is determined that any of your referrals did not Voluntarily enter their information, you will forfeit any and all claim to any and all paymentouts earned through our Promoter Programs. We must have this policy in place to ensure that ALL medical professionals using our free service have done so of their own free will without coercion. Remember, "The Candidate Owns The Candidate".
Payment Under our Promoter Programs
Promoters are paid once per month. That payment shall include the applicable promoter share of revenue we have RECEIVED, DEPOSITED AND VERIFIED FUNDS HAVE CLEARED OUR BANK account during the previous month. In the event an entity owes medXcentral an agreed upon Finder's Fee and has not paid, medXcentral will make good faith efforts to collect such fees. Once past due fees are collected, received, deposited and have cleared medXcentral's Bank Account, the Promoter Share will be included in the subsequent scheduled payout. If medXcentral does not get paid, the Promoter does not get paid. |
